Privacy Policy of the Case Management System

 

Please note that the Unified Patent Court (UPC) collects certain information or data about you when you use the UPC’s Case Management System (herein after “the CMS”, “the CMS platform” or “the site”).

This includes:

  • Queries and requests via API, CMS navigation logs that you leave, including your email address.
  • Your IP address and details of which version of web browser you used.
  • Information on how you use the CMS platform, using cookies and page tagging techniques to help us improve the site.
  • Details to allow you to access CMS functionalities e.g. an email address.

The data will only be used for the purposes you provide it for.

 

This helps us to:

  • Improve the CMS platform by monitoring how you use it.
  • Respond to any feedback you send us, as required.

 

By using the CMS you agree to this Privacy Policy. Any modification to the Privacy Policy will be notified by communication on the UPC’s website.

You can ask the Court not to use any of the information collected. Please contact the UPC’s Data Protection Officer.

Where your data is stored

We store your data on secure servers in Luxembourg, where the UPC’s staff or suppliers could view it. By using the CMS, you agree for your data to be stored by the UPC.

Keeping your data secure

Transmitting information over the internet always carries risks. The UPC uses every effort to minimize those risks, notably for data transmitted via API but we cannot guarantee full security of your data. Any data you transmit is at your own risk.

The CMS included procedures and security features in place to try and keep your data secure once received. We will not share your information with any other organizations for marketing, market research or commercial purposes and we do not pass on your details to other sites.

 

 

Disclosing your information

Besides disclosure of personal data in the context of the judicial functions of the Court, the Court may pass on your personal information if it has a legal obligation to do so.

Cookies

The CMS puts small files (known as “cookies”) onto your computer to collect information about how you browse the site.

Cookies are used to:

  • Measure how you use the CMS so it can be updated and improved based on your needs.
  • Remember the notifications you have seen so that we don’t show them to you again.

Cookies are not used to identify you personally.

You will normally see a message on the site before we store a cookie on your computer.

Measuring CMS usage (Google Analytics)

The UPC use Google Analytics software to collect information about how you use the CMS.  This is done to help make sure the site is meeting the needs of its users and to help us make improvements.

Google Analytics stores information about:

  • The pages you visit on CMS.
  • How long you spend on each CMS page.
  • What you click on while you’re visiting the site.

We do not collect or store your personal information (eg your name or address) so this information cannot be used to identify you personally.

Data protection

The Guidelines for the protection of personal data of the Unified Patent Court (“the Guidelines”) control how your personal information is used by the UPC.

Processing of data will be done under the Principles and Lawfulness of Processing (Article 4 of the Guidelines), according to which:

(1) Processing of personal data shall be done according to the principles in accordance with Article 5 et seqq. EU-GDPR having due regard to Article 9 paragraph 2 lit.f EU-GDPR.

(2) Processing of personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, and the processing of genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or data concerning a natural person's sex life or sexual orientation shall not be done except if one of the conditions apply that are listed in Article 9 paragraph 2 EU-GDPR.
